CHOCOFEST TERMS AND CONDITIONS

Welcome to ChocoFest.ca. By accessing this website, purchasing tickets, attending a ChocoFest event, or using any services offered through this website, you agree to be bound by these Terms and Conditions.

  1. ABOUT CHOCOFEST

ChocoFest is a chocolate tasting festival produced by Mountainlion Events Ltd. These Terms and Conditions govern your use of the ChocoFest website, ticket purchases, event attendance, and related services.

If you do not agree with these Terms, please do not use this website or attend a ChocoFest event.

  1. WEBSITE USE

You may use this website for lawful personal purposes only.

You may not:

• Use the website in any manner that could damage, disable, or impair its operation.
• Attempt to gain unauthorized access to any portion of the website, servers, or systems.
• Copy, reproduce, distribute, publish, modify, or commercially exploit website content without prior written permission.
• Use automated tools, bots, spiders, scraping technologies, or data-mining tools to collect information from the website.

All content on this website, including text, graphics, logos, photographs, videos, branding, and other materials, is the property of ChocoFest, Mountainlion Events Ltd., or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

  1. TICKET PURCHASES

Admission tickets and Taste Tickets may only be purchased through the official ChocoFest website or an authorized ticketing provider designated by ChocoFest.

ChocoFest does not authorize the resale of tickets through third-party marketplaces, online classified services, social media platforms, ticket brokers, or private sellers.

Tickets purchased from unauthorized sources may be:

• Invalid or fraudulent.
• Duplicated or previously redeemed.
• Cancelled without notice.
• Refused for entry.

ChocoFest is not responsible for losses resulting from tickets purchased through unauthorized sellers and cannot guarantee the validity of such tickets.

Attendees are strongly encouraged to purchase tickets only through the official ChocoFest website.

Tickets may not be reproduced, copied, altered, transferred for commercial gain, or used for promotional contests without the prior written consent of ChocoFest.

Admission tickets are valid only for the date, session, and time period specified at the time of purchase. Entry outside the designated admission period is not guaranteed and may be denied based on venue capacity and event operations.

All prices are listed in Canadian dollars and are subject to applicable taxes and fees.

All ticket sales are final unless otherwise required by law.

ChocoFest reserves the right to:

• Refuse admission.
• Verify the identity of ticket holders where fraud is suspected.
• Cancel tickets obtained through unauthorized or fraudulent means.
• Remove attendees who engage in disruptive, unsafe, illegal, or inappropriate behaviour.
• Modify event schedules, programming, vendors, speakers, demonstrations, classes, activities, or event features without notice.

For the safety and security of attendees, exhibitors, volunteers, and staff, ChocoFest reserves the right to conduct reasonable security screening, including visual inspection of bags, backpacks, packages, or other items brought into the event. Individuals who refuse such screening may be denied entry or removed from the event without refund.

  1. EVENT CANCELLATION OR POSTPONEMENT

ChocoFest reserves the right to cancel, postpone, relocate, or modify the event due to circumstances beyond its reasonable control, including but not limited to severe weather, venue issues, public health emergencies, government restrictions, labour disputes, natural disasters, technical failures, or other force majeure events.

In the event of cancellation, refunds, credits, or transfer options will be determined by ChocoFest in accordance with applicable law.

  1. TASTE TICKETS

Taste Tickets are a digital festival currency used to redeem samples from participating chocolate makers and exhibitors.

Taste Tickets:

• Have no cash value.
• Are not redeemable for cash.
• May not be exchanged for cash refunds.
• May only be used during designated ChocoFest events.
• Are subject to the policies published on the ChocoFest website at the time of the event.

ChocoFest reserves the right to deactivate, suspend, or cancel any Taste Ticket balance associated with fraudulent activity, unauthorized duplication, abuse of the ticketing system, or violation of these Terms.

Unused Taste Tickets will be handled in accordance with the policy published on the ChocoFest website at the time of the event.

  1. AGE RESTRICTIONS AND ADMISSION CATEGORIES

Certain admission categories may be restricted by age or eligibility requirements.

ChocoFest reserves the right to request proof of age or eligibility for admission categories including, but not limited to:

• Senior admission.
• Adult-only sessions.
• Child admission.

Individuals unable to provide satisfactory proof of eligibility may be required to purchase the appropriate admission category or may be denied entry.

  1. FOOD ALLERGY AND DIETARY DISCLAIMER

Food and beverage products sampled, sold, or displayed at ChocoFest are provided by independent exhibitors.

Products may contain or have been manufactured in facilities that process common allergens, including but not limited to:

• Peanuts
• Tree nuts
• Dairy
• Soy
• Wheat
• Sesame
• Eggs

ChocoFest cannot guarantee an allergen-free environment.

Attendees are solely responsible for reviewing ingredients and discussing allergy concerns directly with exhibitors before consuming any product.

  1. ASSUMPTION OF RISK

Attendance at ChocoFest and participation in festival activities are voluntary.

By attending ChocoFest, you acknowledge and accept all risks associated with attendance, including but not limited to:

• Consumption of food and beverages.
• Allergic reactions.
• Crowded public spaces.
• Slips, trips, and falls.
• Interactions with vendors, volunteers, exhibitors, contractors, and other attendees.

Participation is entirely at your own risk.

  1. PHOTOGRAPHY AND VIDEO RECORDING

ChocoFest may photograph, film, livestream, record audio, or otherwise capture portions of the event.

By attending, you grant ChocoFest, Mountainlion Events Ltd., and its authorized representatives permission to use your image, likeness, voice, appearance, and statements in photographs, videos, livestreams, social media content, advertising, promotional materials, websites, and future marketing initiatives without compensation or further notice.

  1. THIRD-PARTY VENDORS

Products sold, sampled, displayed, or promoted at ChocoFest are offered by independent businesses.

ChocoFest does not manufacture, inspect, endorse, guarantee, or warrant products offered by exhibitors.

Any purchase, transaction, warranty claim, dispute, product concern, injury, or loss relating to vendor products or services is solely between you and the applicable vendor.

This website may contain links to third-party websites for your convenience.

ChocoFest is not responsible for the content, security, privacy practices, products, services, or policies of third-party websites and does not endorse them unless expressly stated.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, ChocoFest, Mountainlion Events Ltd., its directors, officers, employees, volunteers, contractors, sponsors, venue partners, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from:

• Use of this website.
• Attendance at ChocoFest.
• Participation in festival activities.
• Consumption of food or beverages.
• Purchases made from exhibitors.
• Technical failures or service interruptions.
• Loss of data, profits, opportunities, or personal property.

Where liability cannot be excluded by law, liability shall be limited to the amount paid by the attendee for admission to the applicable event.

You agree to indemnify and hold harmless ChocoFest, Mountainlion Events Ltd., its directors, officers, employees, volunteers, contractors, sponsors, and partners from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Your violation of these Terms.
• Your misuse of the website.
• Your conduct while attending a ChocoFest event.
• Your violation of any applicable law.
